These Terms shall be governed and construed in accordance with the laws of Malta, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

ANTI-MONEY LAUNDERING & KYC POLICY AND PROCEDURES

These are the Anti-Money Laundering (ALM) Policy and Procedures adopted by GAIA Energy Projects Ltd. in compliance with The Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017 (MLR). GAIA will actively prevent and take measures to guard against being used as a medium for money laundering activities and terrorism financing activities and any other activity that facilitates money laundering or the funding of terrorist or criminal activities. To these ends:
- The identities of all new and existing clients will be verified to a reasonable level of certainty
- A risk-based approach will be taken to the monitoring of client tax and accounting affairs
- Any suspicious activity will be reported, and all AML activities recorded
- GAIA Energy Projects Ltd., by it´s CEO Mr. Robert Reich will act as the Money Laundering Reporting Officer (MLRO) to coordinate the AML policies and procedures of the business.
- All individuals out of “High Risk and other monitored jurisdictions” as specified on the webpage (http://www.fatf-gafi.org/countries/#high-risk) are excluded of any public offer or purchase of any of our products and/or service.
- Every participant, irrespective if he is acting as individual and/or institutional customer of our services, has to fulfill KYC (Know your customer) rules for any purchase from GAIA Projects Ltd. – that exceed the commercial value of € 5000 EUR.
This will require different Documents, in order to clearly establish the identity and the address of an individual and will be collected and stored from an external KYC provider. The KYC process will be performed according to the applicable regulations, an may include one or more of the following documents:
List of documents commonly accepted as Standard Identity Proof:
- PAN Card
- Voter’s Identity Card
- Driving License
- Photo identity proof of Central or State government
- Ration card with photograph
- Letter from a recognized public authority or public servant
- Bank Pass Book bearing photograph
- Employee identity card of a listed company or public sector company
- Identity card of University or board of education like ISC, CBSE, etc.
List of common identity documents which are accepted as Standard Address Proof:
- Voter’s Identity Card
- Driving License
- Electricity Bill, Telephone bill including mobile, landline, wireless, etc type of connections, not more than 6 months old
- Bank Account Statement
- Consumer Gas connection card or Gas Bill
- Letter from any recognized public authority or public servant
- Credit Card Statement
- House Purchase deed
- Lease agreement along with last 3 months rent receipt
- Employer’s certificate for residence proof
